1. Who we are

Commity (the "App", "Service", "we", "us", "our") is operated by FORCEL LTD, a company registered in England & Wales under company number 13315753, with its registered office at 71-75 Shelton Street, London, Greater London, WC2H 9JQ, United Kingdom. These Terms of Service (the "Terms") govern your access to and use of the App and related services.

By creating an account, downloading the App, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility & age

You must be at least 16 years old to use Commity. Because the Service can result in charges to a payment card, if you are under 18 you may only use it with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf and accepts responsibility for any charges. By using the Service you represent that you meet these requirements and have the legal capacity to enter into this contract.

3. Your account

You need an account to use Commity. You agree to provide accurate information, keep your login credentials secure, and remain responsible for everything that happens under your account. Tell us promptly if you suspect unauthorised use. You may not create more than one account, impersonate anyone, or share your account.

4. What Commity does

Commity is a self-accountability tool. You create a "commitment" by choosing a location (your "spot"), a daily goal (for example, a number of minutes), the days of the week it applies, and a money "stake". The App uses your device's location to detect when you are physically present at your spot and logs the time you spend there. If you reach your daily goal on a scheduled day, the day is marked complete. If you do not, the day counts as missed.

The "comeback" is a recovery feature: if your stake is charged, you may start a comeback within 30 days and earn the money back by completing a streak of your previously scheduled days, as described in the App. Features may change over time.

5. Location & verification

The Service depends on location data. To work, Commity needs you to grant the location permissions it requests — including, on most devices, background or "always" location access — and to keep location services and the necessary background permissions enabled. You are responsible for granting and maintaining these permissions and for keeping your device powered and able to run the App.

You acknowledge that GPS and location technology are not perfect. Signal can be weak indoors, near tall buildings, or when a device throttles background activity, which may cause attendance to be recorded inaccurately or not at all. We verify presence on a best-efforts basis using the data your device provides. We are not liable for charges, missed completions, or lost stakes caused by location inaccuracy, denied or revoked permissions, device or operating-system behaviour, connectivity issues, or anything else outside our reasonable control. If you believe a day was recorded incorrectly, contact us (see Section 18) and we will review it in good faith, but completion ultimately depends on the location data available to us.

You must not spoof, fake, simulate, or otherwise manipulate your location or the App's tracking.

6. Stakes, payments & billing

You are responsible for keeping a valid payment method on file. If a charge fails, we may retry it, suspend tracking, or restrict your account until payment is resolved.

7. Refunds

Except where required by law, charges are final and non-refundable. The intended way to recover a charged stake is the in-app comeback described in Section 4. To the extent you have a statutory right to cancel or to a refund (for example, certain consumer rights), nothing in these Terms removes that right.

8. Acceptable use

You agree not to: (a) spoof, fake or manipulate location or attendance; (b) use the Service fraudulently or to commit a chargeback in bad faith; (c) create multiple or fake accounts, or game the comeback, leaderboard or stakes; (d) interfere with, reverse-engineer, or attempt to disrupt the Service or its security; (e) use the Service unlawfully or to harass others; or (f) use automated means to access the Service except as we expressly permit. We may remove content or suspend accounts that breach these rules.

9. Availability & accuracy

The Service is provided on an "as is" and "as available" basis. We do not warrant that tracking will be uninterrupted, timely, secure, or error-free, or that every visit will be detected. We may modify, suspend, or discontinue any part of the Service at any time. Where reasonably possible we will give notice of material changes that affect billing.

10. Health & fitness disclaimer

Commity is a motivation tool, not a medical, fitness, or health service, and does not provide medical advice. Always consult a qualified professional before starting or changing any exercise or wellbeing routine. You participate in any activity at your own risk.

11. Intellectual property

The App, its content, branding, and software are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial use in line with these Terms. You retain ownership of content you create (such as your commitment details); you grant us the licence needed to operate the Service.

12. Third-party services

Commity relies on third parties including Stripe (payments), Supabase (database and authentication), and Apple and Google (app distribution, push notifications, and location/maps services). Your use of those features may also be subject to the relevant third party's terms. We are not responsible for third-party services we do not control.

13. Disclaimers & limitation of liability

To the fullest extent permitted by law, we exclude all implied warranties. Nothing in these Terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or for fraud). Subject to that, we are not liable for indirect, incidental, special, or consequential losses, or for lost stakes, charges, missed completions, or data loss arising from location inaccuracy, device behaviour, or matters outside our reasonable control. Subject to the foregoing, our total aggregate liability arising out of or relating to the Service in any 12-month period is limited to the greater of (a) the total amounts you were charged by us in that period and (b) £100.

14. Indemnity

You agree to indemnify and hold us harmless from claims, losses, and expenses arising out of your misuse of the Service, your breach of these Terms, or your violation of any law or third-party right.

15. Suspension & termination

You may stop using Commity and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if necessary to protect the Service or other users. Provisions that by their nature should survive termination (including billing for charges already incurred, disclaimers, and limitation of liability) will survive.

16. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will take reasonable steps to notify you (for example, in-app or by email). Continuing to use the Service after changes take effect means you accept the updated Terms.

17. Governing law & disputes

These Terms and any dispute arising out of them are governed by the laws of England & Wales, and the courts of England & Wales have jurisdiction, except that if you are a consumer resident elsewhere you may benefit from mandatory protections of your local law and the courts of your place of residence. We encourage you to contact us first so we can try to resolve any issue informally.
